01. Acceptance of Terms

By accessing the website or purchasing products of Kanika Khad Pvt. Ltd. ("we," "us," or "the Company"), you agree to be bound by these Terms and Conditions in full. If you do not accept these terms, please do not use our services.

We reserve the right to revise these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.

02. Products & Services

Kanika Khad provides agricultural inputs including but not limited to:

• Registered insecticides, fungicides, and herbicides
• Bio-pesticides and botanical formulations
• Chemical and organic fertilisers
• Plant growth regulators and micronutrients
• Agri-technical consultancy and crop advisory services

All products are sold subject to availability. Product specifications, pack sizes, and formulations may change without prior notice in line with regulatory requirements.

03. Orders & Payments

All orders placed are subject to confirmation by Kanika Khad. Prices are listed in Indian Rupees (INR) exclusive of applicable taxes (GST) unless stated otherwise.

• Bulk orders require a purchase order and may require advance payment or credit terms as agreed.
• Retail purchases must be paid in full at the point of sale or delivery.
• We accept payment via NEFT/RTGS, UPI, cheque, and cash as per applicable limits.
• Prices are subject to change without notice; confirmed orders honour the agreed price.

04. Safety & Regulatory Compliance

By purchasing our products, you agree to:

• Read and follow all label instructions, safety data sheets (SDS), and directions for use
• Use appropriate personal protective equipment (PPE) as specified
• Store products safely, away from children, food, and water sources
• Comply with the Insecticides Act, 1968, Fertiliser Control Order, and all applicable local regulations
• Dispose of empty containers as per PCB (Pollution Control Board) guidelines
• Not use products for purposes other than those listed on the label

Kanika Khad shall not be liable for damage arising from misuse, incorrect application, or non-compliance with label instructions.

05. Returns & Refunds

Due to the nature of agri-chemical products and safety regulations, returns are accepted only in cases of:

• Manufacturing defects confirmed by our quality team
• Incorrect product dispatched by Kanika Khad
• Damaged goods received (to be reported within 48 hours of delivery with photographic evidence)

Returns must be in original sealed packaging. Opened or used products cannot be returned. Refunds or replacements will be processed within 14 working days of approval.

06. Dealership & Distribution

Authorised dealers and distributors are bound by a separate Dealership Agreement in addition to these Terms. Resellers must:

• Hold valid pesticide dealer licences as required under the Insecticides Act, 1968
• Maintain proper storage conditions as per product specifications
• Not sell products beyond their licensed territory without written permission
• Ensure end-users receive proper usage guidance and safety information

07. Intellectual Property

All content, branding, product names, formulations, trade marks, and website materials are the exclusive property of Kanika Khad Pvt. Ltd. Unauthorised reproduction or commercial use of any intellectual property is strictly prohibited and may result in legal action.

08. Limitation of Liability

Kanika Khad's liability, in any case, shall not exceed the invoice value of the specific product in question. We are not liable for crop loss, yield reduction, or consequential damages arising from use or misuse of products unless a manufacturing defect is proven.

Field performance may vary based on soil type, crop variety, climatic conditions, application method, and pest resistance. Our recommendations are advisory in nature.

09. Governing Law

These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts in Nagpur, Maharashtra. Any dispute not resolved amicably shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
